For generations, trusts have been used as a traditional estate planning tool to protect family wealth. Often, trusts are created to shield personal and family assets from current or prospective spouses. Yet, the best laid plans of well-intentioned practitioners can be upset by courts in divorce litigation. Courts typically do not consider a party’s trust interests as property subject to distribution in a divorce.
